These Terms and Conditions govern the use of the Chalo Auto platform, operated by Charudha Journey LLP. By accessing or using the platform, including the website and mobile application, users, drivers, and transport partners agree to comply with these Terms in full.

1. Acceptance of Terms

Welcome to Chalo Auto (“we”, “our”, or “us”). By accessing or using our website, mobile application, or any related booking services for Autos, Bikes, Cars, or Buses (collectively, the “Services”), you (“User” or “You”) agree to be bound by these Terms and Conditions (“Terms”).

If you do not agree with any part of these Terms, you must not use or access our Services.

2. Services Overview

Chalo Auto, operated by Charudha Journey LLP, is an innovative online technology platform designed to simplify and enhance urban and intercity travel. Through our platform, users can conveniently book a variety of transportation services, including Autos, Bikes, Cars, and Buses, for both local commutes and long-distance journeys.

Our role is that of a technology facilitator — we seamlessly connect passengers with a network of verified, independent drivers and licensed transport providers. Chalo Auto does not own, manage, or operate any vehicles directly; instead, we empower users with access to safe, reliable, and efficient mobility solutions through our trusted partners.

3. User Responsibilities

To ensure a safe, reliable, and efficient experience for all, users of the Chalo Auto platform are expected to adhere to the following responsibilities:

Accurate Information: Users must provide complete and truthful details during registration and while making a booking, including their full name, valid contact information, and precise pickup and drop-off locations.
Respectful Conduct: Users are required to maintain courteous and respectful behavior toward drivers, transport partners, and Chalo Auto support representatives at all times.
Timeliness and Payment: Users must be ready for pickup at the scheduled time and complete payment promptly using the chosen payment method.
Prohibited Activities: Any misuse of the platform — including fake or fraudulent bookings, abusive or inappropriate behavior, or any action that violates applicable laws — may result in suspension or termination of the user’s account and may lead to legal proceedings if necessary.

4. Driver and Partner Responsibilities

Drivers and transport partners associated with Chalo Auto are expected to maintain the highest standards of safety, professionalism, and compliance. The following responsibilities apply to all service providers on the platform:

Legal Compliance: Drivers and transport partners must possess all valid licenses, permits, and insurance required under applicable transport laws and regulations.
Vehicle Standards: All vehicles used for service must be roadworthy, well-maintained, clean, and safe to ensure passenger comfort and safety.
Professional Conduct: Drivers must demonstrate punctuality, courteous behavior, and professionalism throughout the service, from pickup to drop-off.
Service Reliability: Drivers and partners are expected to honor accepted bookings and avoid cancellations except in unavoidable circumstances, ensuring consistent reliability for users.

5. Payments and Charges

Chalo Auto is committed to maintaining transparent and secure payment processes for all users and service partners.

Transparent Pricing: All applicable fares, booking fees, and taxes are clearly displayed to users prior to confirming a ride. No hidden charges are applied.
Secure Transactions: Online payments are processed safely through authorized and encrypted payment gateways to protect user information.
User Responsibility: By confirming a booking, users agree to pay the full fare amount as displayed at the time of booking through the selected payment method.
Payment Disputes: Any concerns or disputes related to a transaction must be reported to Chalo Auto within 48 hours of payment for review and resolution.

6. Cancellation and Refund

All cancellations and refund requests are managed in accordance with Chalo Auto’s Return and Refund Policy available on our official website.

Users are strongly encouraged to review this policy prior to making or cancelling any booking to understand applicable terms, eligibility criteria, and timelines for refunds.

Chalo Auto reserves the right to modify or update the Return and Refund Policy from time to time, and such changes will be reflected on the website.

7. Limitation of Liability

Chalo Auto, operated by Charudha Journey LLP, functions solely as a technology intermediary that connects users with independent drivers and transport service providers. We do not own, operate, control, or manage the vehicles, drivers, or their conduct.

Accordingly, Chalo Auto shall not be held liable for:

Delays, accidents, or service disruptions arising from the actions or omissions of third-party drivers or external factors beyond our control,
Loss, theft, or damage of personal belongings during transit, or Any indirect, incidental, consequential, or punitive damages resulting from the use of, or inability to use, our platform or services.

That said, Chalo Auto is committed to providing a safe, reliable, and user friendly platform by verifying partners and continuously improving service standards to enhance user satisfaction.

8. Account Suspension and Termination

Chalo Auto reserves the right to suspend or permanently terminate any user account, driver account, or partner access to the platform under the following circumstances:

Violation of Terms: Breach of these Terms of Service or any related policies.
Fraudulent or Illegal Activity: Engagement in any deceptive, unlawful, or unethical practices while using the platform.
Abuse or Misuse: Misuse of platform features, harassment of drivers, users, or support staff, or any conduct that disrupts normal platform operations.

Chalo Auto may take such actions without prior notice if deemed necessary to protect the safety, integrity, or reputation of the platform, its users, or partners.

9. Intellectual Property Rights

All content available on the Chalo Auto platform — including but not limited to logos, designs, graphics, trademarks, text, images, software, and user interface elements — is the exclusive intellectual property of Charudha Journey LLP and is protected under applicable intellectual property and copyright laws.

No part of the Chalo Auto website, mobile application, or related materials may be copied, reproduced, modified, distributed, displayed, or used in any manner without the prior written consent of Charudha Journey LLP.

Unauthorized use or reproduction of any content or material from the platform may result in legal action in accordance with applicable laws.

10. Wallet System for Drivers and Partners

Chalo Auto provides a digital wallet system ("Wallet") within the Chalo Auto application for registered auto drivers and transport partners.
Each driver or partner is required to maintain a minimum wallet balance to access and accept ride bookings.
Wallets can be recharged with denominations of ₹100, 200,300,400 or 500 or as otherwise made available through the Chalo Auto app.
Wallet recharges can be purchased securely through authorized payment gateways integrated into the Chalo Auto app.
For every confirmed ride or service accepted through the platform, a service fee or commission will be automatically deducted from the driver's wallet balance as per the applicable rate or policy.
Drivers must ensure their wallet has a sufficient balance to continue receiving booking requests.
If the wallet balance becomes insufficient, the driver's access to new ride requests may be temporarily restricted until the wallet is recharged.
Wallet balances are non-transferable and non-refundable, except in cases of verified system errors or as otherwise required by law.
Chalo Auto reserves the right to modify wallet usage terms, deduction rates, or recharge limits with prior notice to drivers and partners through the app or official communication channels.

11. Modifications to Terms

Chalo Auto reserves the right to revise, update, or modify these Terms of Service at any time to reflect changes in our services, policies, or applicable laws.

Any such updates will be posted on our official website or mobile application, and the revised Terms will take effect immediately upon publication unless stated otherwise.

By continuing to access or use the Chalo Auto platform after any modifications, users are deemed to have read, understood, and accepted the updated Terms.

12.Governing Law and Jurisdiction

These Terms of Service, and any disputes, claims, or issues arising from or relating to them, shall be governed by and construed in accordance with the laws of India.

All legal proceedings, actions, or claims arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Calicut, Kerala, India.
